OFFICIAL RULES

The following Sweepstakes is intended for participation in the contiguous 48 United States only and shall only be construed and evaluated according to the laws of the United States. Please do not enter this Sweepstakes unless you are a legal resident of the contiguous 48 United States or the District of Columbia and located in the United States at the time of entry.

NO PURCHASE NECESSARY. A purchase does not improve your chances of winning. OPEN TO ANY LEGAL RESIDENT OF THE 48 CONTIGUOUS UNITED STATES AND DISTRICT OF COLUMBIA AND 18 YEARS OF AGE OR OLDER (19 IN AL AND NE) AS OF DATE OF ENTRY. CONTEST IS SUBJECT TO ALL FEDERAL, STATE AND LOCAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED. Employees of 3M, Gage Marketing Group, LLC, ("Sweepstakes Participants") and third-party California Closet Company, Inc. (and its franchisees "California Closets") (Sweepstakes Participants and California Closets together herein "Released Parties") and each of their respective agencies, parents, subsidiaries, affiliates, vendors, officers, directors, agents, wholesalers and retailers involved in this sweepstakes) and their immediate family members (mother, father, sister, brother, husband, wife, daughter, son, step-father, step-mother, step-daughter, step-son, step-brother, step-sister, half-brother, and half-sister) and/or those living in the same household of each are not eligible. Sweepstakes starts 12:00:01 a.m. Central Time ("CT") on April 27, 2009 and ends at 11:59:59 p.m. CT on August 31, 2009 ("Sweepstakes Period").

HOW TO ENTER: Go online to www.scotchbrand.com/contest and complete the online entry form, including your first and last name, email address, address (no P.O. Boxes), city, state, zip code, and date of birth (mm/dd/yyyy). Then click on “submit” to enter the Sweepstakes. Entries must be received by 11:59:59 p.m. (CT) on August 31, 2009.  Any other form of Internet or e-mail entry is void.  Sponsor’s computer is the official time keeping device for the Sweepstakes.  Limit one (1) entry per person or email address, per calendar day (based on CT). 

All entries are the property of Sponsor and will not be returned.  By entering, participant agrees to abide by and be bound by these rules and the decisions of an independent judging agency, selected by Sponsor, whose decisions are final and binding in all respects.

No mechanically reproduced entries permitted.  Illegible or incomplete entries are void.  Not responsible for late or misdirected entries or entries not received by the entry deadline.  No other attempted method of entry will be accepted.  In the event of a dispute over who submitted an online entry, the entry will be deemed to have been submitted by the authorized account holder of the email account identified on the online entry form. The authorized account holder is deemed to be the natural person who is assigned to an email address by an Internet access provider, service provider, or online organization responsible for assigning email addresses for the domain associated with the submitted email address. 

DRAWING: One (1) Grand Prize winner (subject to verification) will be selected in a random drawing held on or about September 9, 2009 from all eligible entries received.  The Grand Prize winner will be notified by mail and/or email.  Decisions of the judges are final. Odds of winning the Grand Prize depend upon the number of eligible entries received.  

PRIZE DESCRIPTION: (1) One Grand Prize, also referred to as an “Everyday Organizer Prize Package” consists of one (1) $4,000 gift certificate for California Closets® storage space solutions. Total Approximate Retail Value (ARV):  $4,000.  Gift certificate is not redeemable or exchangeable for cash and is subject to all terms and conditions of use as established by California Closets®.  The $4,000 gift certificate for California Closets storage space solutions will be valid for up to one year from the date the winner is notified by Sponsor.  Sponsor is not responsible for lost or stolen gift certificates.  Total ARV of Grand Prize:  $4,000.  If the winner does not live in an area serviced by a California Closets franchise, Sponsor, at its sole discretion, reserves the right to offer the winner a cash alternative in lieu of the stated prize.  If the winner cannot accept prize as stated, prize will be forfeited and an alternate winner will be chosen.  Return of any prize/prize notification as undeliverable will result in disqualification and an alternate winner may be selected.  No substitution, cash redemption or transfer of prize by winner permitted, other than those stated herein.  Sponsor, in its sole discretion, reserves the right to substitute prize of equal or greater value should a prize be unavailable at the time of the prize award.  Sponsor is not responsible for the quality or utility of any prize or any portion of prize.  Sponsor makes no warranty with respect to any portion of prize. All federal, state and local taxes are the sole responsibility of winner. 

RELEASES: By entering, participant releases Sponsor, Released Parties and their respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, and the employees, contract workers, officers, directors and agents of any of the above organizations from any and all liability for any injuries, losses and damages to any person (including but not limited to death) and to property of any kind caused in whole or in part, directly or indirectly, by participation in the sweepstakes or the acceptance, possession or use/misuse of the prize or participation in any prize-related activities.

By accepting a prize, the winner agrees to the use of his/her name and address (city, state), photograph, likeness and statements made by the winner regarding the sweepstakes and Sponsor for advertising, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide and on the Internet and World Wide Web, without notice, review or approval, where permitted by law. Winners will be required to complete, sign and return an Affidavit of Eligibility, a Liability Release, and, where lawful, a Publicity Release within fourteen (14) days of notification. If documents are not returned timely, or if prize notification or prize is returned as non-deliverable, or if a winner is found to be ineligible or otherwise not in compliance with these Official Rules, prize to the winner (as deemed appropriate by Sponsor) will be forfeited and an alternate winner selected.

GENERAL RULES: By participating in this Sweepstakes, entrants agree to be bound by the Official Rules and the decisions of the judges.  The failure of either Sponsor or the Released Parties to comply with any provision of these Official Rules due to an act of God, act of domestic terrorism, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of either (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules. Sponsor and the Released Parties are not responsible for any typographical or other error in the printing, the offering or the announcement of any prizes or in the administration of the promotion.

LIMITATIONS OF LIABLITY: Sponsor and other Sweepstakes Participants are not responsible for: (i) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software, delay in operation or transmission, communications line failure, technology outage, theft or destruction or unauthorized access to, or alteration of entries, whether caused by the sender or any of the equipment or programming associated with or utilized in the Sweepstakes; (ii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iii) unauthorized human intervention in any part of the entry process or the Sweepstakes; (iv) electronic, clerical or human error which may occur in the administration of the Sweepstakes or the transmission, receipt or processing of entries or notification of winners; or (v) any injury or damage to persons or property, including but not limited to entrant's computer, hardware or software, which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Sweepstakes.  Without limiting the generality of the foregoing, Sponsor reserves the right, in its sole discretion, to terminate, modify, cancel or suspend this Sweepstakes if fraud, technical failures including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes beyond the control of Sponsor corrupt the administration, security, or proper play, of the Sweepstakes.  In the event of termination, prize will be awarded in a manner to be determined by Sponsor consistent with the Official Rules and applicable laws.  Under no circumstances, including negligence, shall the Sponsor or the other Releasees be liable for any direct, indirect, incidental, special or consequential damages that result from the use of or inability to use the web site, or out of any breach of any warranty.  This exclusion or limitation of liability will not apply to the extent that any applicable statute prohibits such exclusion or limitation of liability. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE SPONSOR’S WEB SITE IS PROVIDED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES; CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS REGARDING THESE LIMITATIONS OR RESTRICTIONS.  Any attempt by an entrant or other individual to deliberately damage any web site or undermine the legitimate operation of this promotion, including but not limited to any fraudulent claims, may be a violation of criminal and civil laws.  Should such an attempt be made, Sponsor reserves the right to seek remedies and damages from any such individual, to the fullest extent permitted by law, including criminal prosecution. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.  Participant engaging in any of the foregoing activities may be disqualified and will forfeit any prizes won.
