  • ‘Monumental’ Montreal Protocol Amendment to Aggressively Phasedown Hydrofluorocarbons (HFCs)

    Delegates from 197 countries a reached a landmark deal to phasedown use of the fastest growing greenhouse gases, hydrofluorocarbons (HFCs), at the 28th Meeting of the Parties to the Montreal Protocol in Kigali, Rwanda. According to BBC News, U.S. Secretary of State John Kerry has declared this amendment “a major victory for the Earth” and a “monumental step forward, that addresses the needs of individual nations but will give us the opportunity to reduce the warming of the planet by an entire half a degree centigrade.” The new agreement phases down highly developed countries before developing countries.

    At the United Nations conference in Rwanda, 197 nations agreed to drastically reduce their use of HFCs, potent greenhouse gases used in air conditioners, refrigerators as well as solvent cleaning and vapor degreasing applications. HFCs were developed in the 1990s to replace hydrochlorofluorocarbons (HCFCs) and other ozone depleting substances. Although HFCs used in solvent cleaning applications, like Chemours’ Vertrel™ products containing HFC 43-10mee and Solvay Solkane™ and Solvokane™ products containing HFC-365mfc are not ozone depleting, they have high global warming potentials (GWPs). The continued growth of HFCs would make them a major contributor to climate change, so nations decided to phasedown their production under the same treaty that dealt with HCFCs, the Montreal Protocol.

    On July 27, the U.S. Environmental Protection Agency (EPA) sent a proposal to The White House for final review, which would enact new restrictions on the use of the degreasing chemical trichloroethylene (TCE). According to the Chemical Regulations Reporter®, it remains unclear if the proposal would aim to enact a partial ban or phasedown of TCE to help prevent workplace exposure to the chemical, or if a full ban is recommended. Details of the proposal will not be released until The White House completes its final review (expected November 2016).

    Section 6(a) of the Toxic Substances Control Act (TSCA) provides authority for the EPA to ban or restrict the manufacture (including import), processing, distribution in commerce, and use of chemicals, as well as any manner or method of disposal. With this new proposal, the EPA will determine whether the continued use of TCE would pose an unreasonable risk to human health and the environment in vapor degreasing applications (RIN 2070-AK11) and as a spotting agent in dry cleaning and in certain consumer products (RIN 2070-AK03).

    In the Climate Action Plan, President Obama directed his Administration to purchase lower GWP alternatives to high global warming potential (GWP) hydrofluorocarbons (HFCs) whenever feasible. The U.S. Department of Defense (DoD), National Aeronautics and Space Administration (NASA) and General Services Administration (GSA) issued a final rule to amend their acquisition practices to meet the plan’s goals.

    It’s official. Effective June 15, 2016, the U.S. DoD, GSA and NASA issued a final rule amending the Federal Acquisition Regulation (FAR) to implement the President’s Climate Action Plan to procure, when feasible, alternatives to high GWP HFCs.

    U.S. EPA to Reassess SNAP Status of HFCs in Fire Suppression
    The U.S. Environmental Protection Agency (EPA) released a prepublication version of the Significant New Alternatives Policy (SNAP) program Rule 21, which, among other initiatives, changes the status of a number of substitutes that were previously listed as acceptable. Coming on the heels of the SNAP Fire Suppression Stakeholder Workshop, SNAP Rule 21 notes high GWP HFCs represent a substantial portion of the products in the fire protection market. The HFCs most commonly sold into fire suppression, such as FM-200™, have a GWP that is more than 3000 times that of CO2. The U.S. EPA is requesting updated information on the continuing use of hydrofluorocarbons (HFCs), such as FM-200™, use in fire extinguishing applications and the availability of substitutes or alternative technologies or processes that would obviate their continued use.
